Warranties
The Novia Networks Promise
Novia Networks warrants to the original end user whom purchased the equipment. Our warranty states that products purchased from Novia Networks will be free from defects in material and workmanship for the lifetime of the product if it is properly used and maintained. This is a hardware only warranty.
Novia Networks agrees, for a period of one (1) year from the date of purchase, to provide an advanced replacement via next business day delivery for any covered item determined by us to be defective on a best efforts basis, with all shipping costs borne by us. Failed unit is to be adequately packaged and returned to Novia Networks, prepaid, via any ground service of your choosing.
After the first year of the product being in service, Novia Networks Warranty coverage converts to a repair or replace status, for the life of the time that the original user and purchaser of the equipment has possession of the product. We will repair or replace any failed products in a timely manner after receiving the original failed item back from you. After the first year, shipping costs to Novia Networks are the responsibility of the purchaser, and standard ground shipping costs back to the purchaser are paid for by Novia Networks.
This lifetime warranty does not apply to failure of the product resulting from neglect, misuse, abuse, accident, flooding, physical harm to, electrical issues, power surges, incorrect voltages or other electrical stress, modification, force majeure or mishandling. If you improperly adjusted or maintained your item, or exposed the item to the incorrect environmental conditions, improperly installed or configured your item, these will not be reasons for warranty to be applied.
The warranty period for the repaired or replaced product shall be based on the original Novia Networks sale date to you of the product.
Certain exceptions, and limitations, restrictions apply:
- Our warranty is for the end user of the product only, and if resold, the warranty is void.
- The warranty is for the end user of the equipment in the Continental US only.
- This warranty does not cover software products, batteries, licenses, or SmartNet contracts
Novia Networks responsibility for malfunctioning and defects in hardware is strictly limited to replacement for defects only as they relate to our Lifetime Warranty Statement.
Except for the express warranties contained in this warranty statement, Novia Networks disclaims all other warranties and conditions, express or implied, statutory or otherwise, for the product, including but not limited to any implied warranties and conditions of merchant-ability, fitness for a particular purpose, performance, suitability, or non-infringement. Any implied warranties that may be imposed by law are limited in duration to the limited warranty period. Some states, jurisdictions do not allow the exclusion of certain implied warranties or conditions, or limitations on how long an implied warranty or condition lasts, so this limitation may not apply to you. This lifetime warranty coverage terminates if you sell or otherwise transfer this product to another party.
Novia Networks does not accept any liability, beyond the remedies provided for in this lifetime warranty or for special, indirect, consequential or incidental damages, including, without limitation, any liability for third-party claims against you for damages, for products not being available for use, or for lost data or lost software. Novia Networks liability will be no more than the amount you paid for the product that is the subject of a claim. This is the maximum amount for which Novia Networks is responsible. Cisco products sold through our Ebay auctions are not eligible for our Lifetime Warranty noted here, and are instead bound by the warranty terms stipulated under each unique auctions terms and conditions.
